REGULATIONS In order to provide you with a peaceful and safe holiday, please read and apply the rules described in these regulations, which define the conditions under which you can make a reservation and rent a House. By making a reservation, you accept the terms and conditions of renting the House and the rules of its proper and safe use. the update of the regulations is valid from 01/07/2022 the terms used in the regulations: House - part of a residential building constituting the ground floor and attic presented on the website Contact us Lessor - FU Masterplan Jerzy Wilk NIP Contact us Person making the reservation - person interested in renting the House Tenant - a person who made the Advance Payment, thus committing himself to comply with these Regulations. TERMS AND CONDITIONS OF BOOKING, PAYMENT AND USE OF THE HOUSE I. BOOKING AND PAYMENTS 1. The rental concerns each part of the House (subject to the provisions of section III, points 21.1 and 21.2), described in detail in the rental offer, sent by e-mail to the booking person.2. The cottage is designed for a maximum of 6 people (including children) and can be rented in options for 2 or 4 people (depending on the rooms available, described in detail in the rental offer); the equipment of individual rooms is presented in Annex 1 to the Regulations). It is strictly forbidden to sublet more people. 3. The minimum rental period is 2 (two) hotel days. The hotel day starts at 17:00 and ends at 10:00. 4. Initial booking. Pre-booking can be made by phone or via e-mail. When making an initial reservation, it is necessary to specify the date of stay and the number of people. Initial booking takes place after confirming the availability of the House by e-mail on the basis of the Lessor's unequivocal declaration expressed in the e-mail and is valid for the next 24 hours. 5. Guaranteed reservation takes place after the person making the reservation, via e-mail to the e-mail address: Contact us, confirms the advance payment. From the moment of making the Initial Booking, the time for making an advance payment is 24 hours. Failure to pay the deposit within the indicated period will result in the cancellation of the Initial Booking. 6. The down payment is each time 30% of the total cost of the stay. 7. Payment of the Advance Payment is tantamount to concluding a lease agreement between the parties on the terms set out in these regulations. The booking person, by making the advance payment, confirms that they have read these Regulations and accepts the conditions contained therein. 8. The advance payment is made to the bank account number: 77 1020 2368 0000 2202 0060 8042; the title of the transfer should include: name and surname of the person making the reservation, contact telephone number, start and end date of the stay and a declaration of the number of people (including children) renting the House. 9. In the event of the Lessee's resignation from the reservation for reasons beyond the Lessor's control, the down payment is not refundable. 10. The deposit is collected for the duration of the stay in the amount of 30% of the total cost of the stay and is a security in the event of deterioration of the House, its equipment, property area during the Tenant's stay. The deposit is returned by bank transfer to the Lessee's account within 3 working days from the end of the stay, provided that the condition of the House, the House's equipment and the property is not deteriorated, i.e. the same as at the time of handing over to the Lessee, taking into account normal wear and tear resulting from proper use. 11. The entire amount constituting the cost of stay, along with the deposit, should be paid to the bank account number: 77 1020 2368 0000 2202 0060 8042 in advance, at least 7 working days before the start of the stay. If the Lessee fails to make the payment within the prescribed period, the Lessor reserves the right to terminate the contract. II. ACCOMMODATION 1. The Lessee is obliged to inform the Lessor about the estimated time of arrival at the House, no later than 24 hours before the start of the stay. 2. In the event of the Lessee shortening the period of stay, the amount for the unused period is not refunded. 3. If the Lessee does not arrive within the prescribed period, the guaranteed reservation is canceled at 11:00 am the next day, and the advance payment is not refundable. The remaining amount, constituting the cost of the stay, will be sent to the Lessee's account within 3 working days from the date of canceling the guaranteed reservation. 4. It is possible to extend the stay for an additional fee only in the absence of prior initial reservations of the House by other booking persons. 5. Check-in and check-out take place in the House in the presence of the Lessor or a person authorized by him. III. STAY
1. The Lessee is obliged to maintain general order in the rooms and places intended for common use of the House and on the property. 2. The Lessor, together with the House, gives the tenant and the persons staying with him the premises of the property for use. 3. The Lessor is not responsible for the safety and health of people using the House and the property. The Lessee and persons staying with him are fully responsible. 4. The Lessee may not lend or sublet the House to other Persons. Disclosure of the event described in the preceding sentence gives the Lessor the right to immediately terminate the contract with all the consequences without the need to return the fee paid by the Lessee, constituting the cost of the stay. 5. If the number of people using the House (declared during the booking) is exceeded, it gives the Lessor the right to immediately terminate the contract without the need to return the fee constituting the cost of stay paid by the Lessee. 6. The Lessee is obliged to report to the Lessor any damage or destruction of the furniture, appliances and equipment of the House immediately after checking in. The landlord allows the possibility of finding damage to the so-called hidden. Lack of reservations of the Lessee as to the condition of the House, its equipment and the premises within 1 hour after checking in means that any damage detected after this point will be the Lessee's responsibility. 7. The Lessee bears full financial responsibility for any damage or destruction of the furniture, appliances and equipment of the House during the stay, regardless of the tenant's willful or unintentional fault and the persons staying with him. 8. The Lessee bears sole and full responsibility for the persons staying with him (including children). 9. Users of the House are obliged to comply with the rules of fire safety: a. Smoking and e-cigarettes are strictly forbidden in the House and on the balcony, b. It is not allowed to use any instruments or devices powered by electricity or gas that are not permanent in the House. House equipment and which may create a fire hazard, e.g. electric heaters, heaters, gas burners, c. it is forbidden to bring flammable materials, explosives and materials with an unpleasant odor to the House. d. in the cottage, on the balcony and in the garden, smoking is prohibited. 10. The Lessee has no right to make any repairs or make any outlays or changes to the House. The Lessee is obliged to immediately inform the Lessor about the necessity to make repairs or expenses. 11. In the event of technical defects, the Lessee is obliged to immediately inform the Lessor or a person authorized by him. 12. The Lessor shall not be liable for the loss or damage of money, securities, valuables or items of scientific or artistic value or other material items of the Lessee. 13. The Lessor is not responsible for any inconvenience caused by a temporary power failure. 14. The Lessee is obliged to use the House in accordance with its properties and purpose, in particular, it is not allowed to rearrange the beds in the rooms. 15. The Lessee is obliged to use replacement footwear inside the House (do not wear mountain boots, ski boots, snowboard boots or other boots that could scratch or damage the wooden surface of the stairs and floors).
16. The Lessee is obliged to check if the front door is locked, each time he leaves the House. The Lessor is not responsible for items left in the House. 17. Parking cars is possible only in a designated place indicated by the Lessor. It is strictly forbidden to enter the property of cars and other motor vehicles of people who are not our Guests. The car park is unguarded and the Lessor is not responsible for the theft or destruction of cars and vehicles belonging to the Lessee or persons accompanying him. 18. There is a curfew on the property from 22:00 to 8:00. In the event that the Lessee violates the peace and / or welfare of the neighbors and does not comply with the generally applicable rules of social coexistence and in the event of a justified police intervention, the Lessor has the right to immediately terminate the lease without the need to return the fee paid by the Lessee constituting the cost of stay. 19. The Lessee is obliged to maintain and return the House in a non-deteriorated condition, which applies in particular to leaving before the end of the stay: a. Washed dishes and kitchen utensils, b. Emptying the refrigerator from the Lessee's food and cleaning it, c. Leaving the surroundings of the house in a non-deteriorated condition. . Failure to comply with the above rules results in a deduction of PLN 200 from the cleaning deposit. 20. Pets are not allowed in the House. 21. The Lessee acknowledges that: 21.1. part of the House in the basement, not covered by the rent, is a separate, independent apartment for the Lessor's exclusive use at any time, 21.2. the room in the attic / mezzanine is not included in the rental and is not available to the Lessee IV. INSURANCE AND LIABILITY The price of the services provided by the Lessor of the House does not include insurance of the Lessee's stay. The Lessee (and the Persons staying with him in the House and on the property) use the services at his / her own risk. The Lessor shall not be liable for any injuries, damage, destruction of property and theft of luggage during the entire stay, as well as for damage to health and property of third parties. V. FINAL PROVISIONS 1. The Lessor reserves the right to impose a contractual penalty of up to 20% of the total cost of the stay in the event that the Lessee or accompanying persons grossly and intentionally violate the provisions of these regulations and generally applicable standards, in particular when they cause significant or irreversible damage to the House, its equipment or on the property, they will persistently violate the night silence and disturb the peace of neighbors, or delay checking out. The imposed contractual penalty does not exclude the Lessor's possibility to seek compensation on general terms. 2. In matters not covered by these Regulations, the relevant provisions of the Civil Code shall apply. 3. In the event of a dispute, the parties undertake to try to resolve it amicably. In the event that the above does not allow reaching an agreement, the court competent to hear any disputes between the parties will be the court having jurisdiction over the Landlord's place of residence. VI.
